Current Pre-Licensure Requirements


On or about August 11, 2010, the Legislature approved a statutory amendment to Massachusetts General Law (MGL) Chapter 112, Section 87SS.


Every applicant for a Massachusetts salesperson’s license must submit proof that they have completed 40 classroom hours of instruction in real estate subjects approved by the board.


Brokers License Requirements


An applicant for a broker’s license must prove that they have been actively associated as a salesperson with a real estate broker for at least one year at a minimum of 25 hours per week and has completed a total of 40 additional classroom hours of instruction approved by the board

Additionally, the applicant must show that s/he has fulfilled the experience requirement of actively associating as a salesperson with a real estate broker within three years of taking the broker’s examination. A broker must have a current Massachusetts salesperson license. Neither a broker’s nor a salesperson’s license may be issued to anyone younger than 18.

Continuing Education Subject Matter Curriculum Introduction

Continuing Education


Massachusetts law requires 12 hours of continuing education within each two-year renewal period in topics approved by the board in order for the license to be active.

Every broker and salesperson must provide written certification that the required courses were successfully completed. Anyone who fails to furnish, in a form satisfactory to the board, written certification that the courses were completed will be granted inactive status by the board upon renewal of a license. Anyone who provides a false or fraudulent certificate of completion of coursework will be subject to having a license suspended.


Introduction


The curriculum is comprised of a number of educational modules. Each module is designed to be administered over a two hour period. The licensee is required to complete six different modules in order to satisfy the twelve hour requirement.

These modules, and the curriculum overall, are designed for real estate brokers and salespeople as an overview. Instructors should tailor their presentation based on the level of the class. Naturally, the depth of coverage of each topic within a module will vary. For instance a module being taught to a class of experienced licensees would likely focus more heavily on certain topics and less so others. A group of inexperienced licensees would require a more general overview with equal time given to all the items within a module. Similarly, a group of licensees who practice as commercial agents would require that the presentation incorporate their needs.

This curriculum is designed for real estate brokers and salespeople to enhance their knowledge base of topics beneficial to the protection of the consumer. Although portions are designed to improve understanding of rights and obligations under the law, it is not a substitute for legal counsel. Materials such as state required forms, provided as part of the curriculum should only be used for study purposes and should not be disseminated to the general public. Nothing in this curriculum supersedes any state or federal laws or regulations.

Schools are responsible to ensure their instructors are imparting accurate and current information. This curriculum was developed based on current laws. However, laws change and those changes should be incorporated into classroom materials.

Schools are responsible for procuring any of the referenced or sited materials. Be advised that many of the reference materials are copyrighted and, if used, copyright protections must be honored. Where court decisions are cited contact a law library or the clerk of the court that issued the decision.


Inactive Licensee


With a valid but inactive license, an agent cannot practice real estate but can earn a referral fee from active licensed brokers and can assist with or direct the procuring of prospects. A license may remain inactive for an indefinite period.

If a licensee who is inactive practices real estate, the licensee’s license may be revoked. Also, a licensee who is inactive may apply to the board to reactivate the license upon demonstrating the completion of continuing education requirements for the renewal period immediately preceding the application for reactivation.
